2. Purpose

These General Conditions of Sale (GCS) govern all services and sales carried out by SASU DECRETON – Élec & Confort, in the following areas:

  • Electrical work (high and low current).
  • Heating work (installation, adjustment, maintenance).
  • Plumbing work (installation, troubleshooting, maintenance).
  • Preventive maintenance of technical installations.
  • Maintenance, troubleshooting and renovation in the aforementioned areas.
  • Site coordination and technical assistance.
  • Related activities in compliance with regulations.

3. Scope of application

These T&Cs apply to any contract concluded with consumers Or professionals.
Any order implies full acceptance of the T&Cs.
Any special conditions negotiated shall prevail over the General Terms and Conditions in the event of any contradiction.

4. Order and quote

  • Any service gives rise to a detailed quote (free or paid depending on the case, specified before travel).
  • The quote is valid for 20 days from the date of issue.
  • The order is validated upon written acceptance of the quote and/or possible payment of a deposit.

4 bis. Diagnostics and estimates

Diagnostics constitute a technical service carried out by SASU DECRETON – Élec & Confort, including on-site visits, visual and/or technical checks and, where appropriate, the issue of an oral or written report.

  • Diagnostics are billed according to the current scale (available on the “Prices” page): https://elecetconfort.fr/tarif), unless otherwise agreed in writing by the Service Provider before the intervention.
  • The amount invoiced for the diagnosis is deducted from the final invoice if the work is validated within a maximum period of thirty (30) days following the date of the diagnosis.
  • The time included in the diagnosis varies depending on the package chosen (20 minutes or 1 hour maximum). Any time overrun is billed at the standard hourly rate (€65 excluding VAT/hour), in increments of 30 minutes.
  • In the event of the Client's absence at the scheduled appointment, a travel charge of forty (40) euros excluding tax is due.
  • The “simple quote visit” is free only when no disassembly or technical research is necessary; otherwise, the service is reclassified as a diagnosis.
  • Written reports (expert diagnosis) are provided in PDF format and describe the findings and recommendations; they do not bind the Service Provider to an obligation of results beyond the standards in force and the information provided by the Client.

5. Prices and additional costs

  • Prices are expressed in euros excluding VAT. VAT at the current rate is added to the amount indicated.
  • Additional costs may apply (travel, supplies, late payment penalties, quote fees) and are indicated to the Customer before validation of the order.

6. Payment terms

  • Cash payment upon receipt of invoice, except for special conditions indicated on the quote.
  • Accepted payment methods: bank transfer, cash (within legal limits), credit card (if available).
  • Late payment penalties: increased legal rate + fixed compensation of €40 for recovery costs (art. L441-10 C. com.).

7. Right of withdrawal (private customers)

In accordance with articles L221-18 et seq. of the Consumer Code:

  • The Customer has 14 days from the conclusion of the contract to withdraw, without having to provide reasons or pay penalties.
  • The right of withdrawal does not apply to urgent maintenance or repair work requested by the Customer at his home.
  • Standard withdrawal form: see point 14.

8. Execution of works

  • The execution times are indicated on the estimate. They are expressed in working days, calculated on the basis of 4 days of intervention per week (excluding Friday, reserved for emergencies and quotes), unless otherwise agreed and specified in the quote.
  • These deadlines may be modified in the event of force majeure, bad weather, delay in delivery of equipment, or at the request of the Customer.
  • The work is deemed to be compliant, except for written and reasoned reservations from the Client sent within 7 calendar days following receipt of the work.

9. Legal guarantees

  • Legal guarantee of conformity (articles L217-3 to L217-14 C. conso.): 2 years from delivery or execution.
  • Guarantee against hidden defects (articles 1641 to 1649 of the Civil Code).
  • Two-year guarantee (2 years) and ten-year guarantee (10 years) depending on the nature of the work, in accordance with the law.

10. Liability

SASU DECRETON – Élec & Confort cannot be held liable for any damage resulting from improper use of the products or modifications made by the Customer or a third party without written agreement.

11. Protection of personal data (GDPR)

In accordance with Regulation (EU) 2016/679 on the protection of personal data (GDPR) and the Data Protection Act of 6 January 1978 as amended, the company SASU DECRETON – Electricity & Comfort collects and processes personal data as part of the management of its customers, their orders and the commercial relationship.

Purposes and legal basis: The data collected is necessary for the execution of the contract (order taking, invoicing, on-site intervention) and, where applicable, for compliance with legal obligations (invoicing, warranty, accounting).

Recipients: The data may be transmitted to technical or administrative service providers involved in the execution of the contract (host, subcontractors, accountant), exclusively within the European Union and in compliance with confidentiality.

Retention period: The data is kept for the period necessary to manage the contractual relationship, plus the legal limitation periods (5 years in commercial matters, 10 years for accounting documents).

Rights of individuals: The Client has, at any time, the right to access, rectify, erase, limit, oppose, as well as the right to the portability of his data. These rights can be exercised by writing to contact@elecetconfort.fr or by mail to the head office address.

Claim : In the event of disagreement regarding the processing of their data, the Client may contact the CNIL – www.cnil.fr.

12. Mediation and disputes

In accordance with article L612-1 of the Consumer Code, the Consumer Customer has the right to use a consumer mediator free of charge.

Applicable law: French law.
Competent court: jurisdiction of the registered office for professionals, court of the consumer's domicile for individuals.

13. Force majeure

No party may be held liable for any delay or failure to perform due to a case of force majeure as defined by French case law.
